2. Account registration and security

Users are responsible for maintaining the confidentiality of login credentials and for all activity conducted through their accounts.

Finstock, Inc. may require identity verification, business verification, compliance checks, or additional information before granting, maintaining, or restoring access.

3. Nature of the services

Finstock, Inc. provides technology-enabled market analytics, trading tools, research support, data-driven insights, quantitative models, informational materials, and related services.

Unless separately agreed in writing, Finstock, Inc. does not act as a broker, dealer, exchange, custodian, bank, portfolio manager, fiduciary, or licensed investment adviser.

The services are provided for informational, analytical, research-support, and technology purposes only.

4. No investment, legal, tax, or financial advice

Nothing in the services should be understood as investment, legal, tax, accounting, or financial advice, or as a recommendation, solicitation, endorsement, or offer to buy, sell, or hold any financial instrument.

Information, model outputs, signals, rankings, research materials, commentary, projections, and data are general in nature and may not be suitable for a user's circumstances.

Users remain responsible for evaluating the merits and risks of any transaction and for obtaining independent professional advice where appropriate.

5. Risk disclosure

Trading and investing in financial instruments involve substantial risk and may not be suitable for all users. Market prices may be volatile, illiquid, and unpredictable.

Leverage may amplify gains as well as losses. Past performance is not indicative of future results, and no model, signal, strategy, or service use is represented to achieve profits or avoid losses.

All trading and investment decisions are made solely by the user and at the user's own risk.

6. User obligations and prohibited conduct

Users agree to use the services only in compliance with the terms and applicable laws, rules, and regulations.

Prohibited conduct includes unlawful, fraudulent, deceptive, abusive, harmful, manipulative, disruptive, or unauthorized activity; misrepresentation of identity or qualifications; and attempts to access systems, accounts, data, or features without authorization.

Unless otherwise stated in writing, fees are non-refundable for the current billing period and access may be suspended, downgraded, or terminated after failed payment, chargeback, suspected fraud, or non-payment.

8. Data accuracy, availability, and no warranty of results

Market data, pricing information, models, signals, analytics, alerts, indicators, forecasts, and research content may be delayed, incomplete, unavailable, inaccurate, interrupted, or subject to errors.

Technical failures, connectivity issues, third-party outages, data-source disruptions, market conditions, and system limitations may affect the quality or availability of the services.

Finstock, Inc. does not guarantee accuracy, completeness, timeliness, reliability, availability, performance, or fitness of any part of the services.

9. Intellectual property

The services, including software, models, algorithms, analytics, dashboards, designs, documentation, trademarks, and content, are owned by Finstock, Inc. or its licensors and are protected by intellectual-property laws.

Users receive a limited, revocable, non-exclusive, non-transferable license to access and use the services only as permitted by the terms.

No ownership rights are transferred to users, and unauthorized copying, modification, distribution, or commercialization is prohibited.

10. Privacy and data use

Use of the services is also governed by the Finstock, Inc. Privacy Policy, which explains how information may be collected, used, stored, processed, and shared.

Users acknowledge that data may be processed to operate, secure, analyze, improve, and support the services, subject to applicable law and the Privacy Policy.

11. Third-party services and content

The services may include or link to third-party data, platforms, providers, payment processors, analytics tools, market data sources, or websites.

Finstock, Inc. does not control third-party services and is not responsible for their availability, accuracy, content, terms, privacy practices, or performance.

Users are responsible for reviewing and complying with third-party terms that apply to their use of those services.

12. Restricted jurisdictions and compliance

Users may not access or use the services in any jurisdiction where doing so would violate applicable law or where Finstock, Inc. restricts access.

Users are responsible for complying with sanctions, securities, commodities, foreign exchange, anti-money-laundering, market-abuse, tax, and other applicable rules.

13. Suspension and termination

Finstock, Inc. may suspend, restrict, or terminate access if it believes a user has violated the terms, applicable law, payment obligations, security requirements, or the rights of Finstock, Inc. or others.

Users may stop using the services at any time. Termination does not relieve users of obligations that accrued before termination.

14. Disclaimer of warranties

The services are provided on an as-is and as-available basis to the fullest extent permitted by law.

Finstock, Inc. disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, and any warranty arising from usage or course of dealing.

15. Limitation of liability

To the fullest extent permitted by law, Finstock, Inc. and its related parties will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages.

This includes loss of profits, trading losses, lost revenue, lost data, business interruption, or reliance on any content, signal, model, output, or service feature.

16. Indemnification

Users agree to defend, indemnify, and hold harmless Finstock, Inc. and its related parties from claims, damages, liabilities, losses, costs, and expenses arising from user conduct, misuse of the services, violation of the terms, or violation of law or third-party rights.

17. Changes to services and terms

Finstock, Inc. may modify, suspend, discontinue, or restrict any part of the services at any time.

The terms may be updated from time to time. Continued use after updates become effective constitutes acceptance of the revised terms.

18. Governing law and dispute resolution

The governing law and dispute-resolution process are determined by the terms and any applicable written agreement between the user and Finstock, Inc.

Users agree to resolve disputes in accordance with the procedures and venue specified in the applicable terms.

19. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision does not waive the right to enforce it later.

Users may not assign rights or obligations without permission. Finstock, Inc. may assign or transfer rights and obligations where permitted by law.
